国家药监局综合司关于开展化妆品“线上净网线下清源”风险排查处置工作的通知 药监综妆〔2019〕39号 各省、自治区、直辖市药品监督管理局，新疆生产建设兵团市场监督管理局：为严厉打击利用网络生产销售违法化妆品行为，整顿和规范化妆品市场秩序，逐步建立化妆品网络销售监管制度，国家药监局决定自2019年5月开始，在全国范围内组织开展化妆品“线上净网线下清源”风险排查处置工作，排查处置化妆品网络销售市场安全风险，督促化妆品网络销售者和化妆品电子商务平台经营者落实化妆品经营者主体责任。现就有关事项通知如下：一，指导思想以习近平新时代中国特色社会主义思想为指导，深入贯彻党的十九大和十九届二中、三中全会精神，认真落实“四个最严”要求，针对利用网络（含互联网站、移动互联网应用程序等）生产销售非法添加禁用物质化妆品、假冒化妆品等突出问题，坚持严厉打击违法犯罪与构建监管长效机制并重的原则，推进化妆品安全社会共治，进一步净化线上线下化妆品市场环境，维护公众化妆品消费安全。一、指导思想二，工作目标突出问题导向，排查清理化妆品网络销售者、化妆品电子商务平台销售的违法产品，以及网上展示的违法产品信息、生产企业和产品虚假资质信息；落实主体责任，督促化妆品网络销售者建立并执行化妆品进货查验记录等制度，督促化妆品电子商务平台经营者建立并执行平台内化妆品经营者实名登记、发现违法制止和报告、停止提供电子商务平台服务等制度；建立长效机制，研究并逐步制定化妆品网络销售监管制度；加大宣传力度，引导公众正确树立安全用妆意识，构建化妆品安全社会共治良好格局。 三，工作重点 （一）排查清理违法产品。 集中排查清理化妆品网络销售者、化妆品电子商务平台销售的非法添加禁用物质化妆品、假冒化妆品、无证生产的化妆品、未取得批准文号的特殊用途化妆品、未经备案的非特殊用途化妆品、经国家药监局或者省级药监局公告或者通告不符合国家化妆品卫生标准的化妆品、国家药监局或者省级药监局通知暂停或者停止销售的化妆品、违法宣称药妆、EGF（表皮生长因子）、干细胞等的化妆品等。 （二）排查清理违法产品信息。 集中排查清理化妆品网络销售者、化妆品电子商务平台上展示的化妆品违法宣称功效信息，包括：药妆、EGF（表皮生长因子）、干细胞、细胞提取液、胎盘提取液等。严格区别消毒产品、保健食品等非化妆品产品的网络销售分区，排查清理以非化妆品产品冒充化妆品销售的信息。对在网络销售过程中明示或者暗示具有医疗作用、以引人误解或者混淆的企业名称或者商标等代替产品名称进行宣传的化妆品信息，予以集中清理。 （三）排查清理企业及产品虚假资质信息。 集中排查化妆品网络销售者、化妆品电子商务平台上展示的化妆品生产企业信息和产品资质信息。及时核对国家药监局对应的数据查询页面，对已吊销、冒用其他企业生产许可证、超过有效期未办理延续的企业资质信息，以及已撤销、冒用其他产品注册或者备案信息、超过有效期未办理延续的产品资质信息，予以集中清理。 四，工作措施 （一）组织开展化妆品电子商务平台经营者自查工作。 各省（区、市）药品监管部门要组织本行政区域内化妆品电子商务平台经营者按照风险排查工作重点和要求全面开展自查，督促其建立并执行平台内化妆品经营者实名登记、发现违法制止和报告、停止提供电子商务平台服务等制度。加强对平台经营者化妆品监管法规知识的培训，引导其严格履行法定义务。 （二）组织开展化妆品网络销售者自查工作。 各省（区、市）药品监管部门要指导本行政区域内地市级负责化妆品监督管理的部门组织化妆品网络销售者按照风险排查工作重点和要求全面开展自查，督促其建立并执行化妆品进货查验记录等制度。加强对化妆品网络销售者监管法规知识的培训，引导其守法规范经营。 （三）积极引导行业加强自律、守法经营。 国家药监局指导行业协会强化行业自律的引导作用，倡议作为化妆品网络销售主要渠道的化妆品电子商务平台经营者，积极参与化妆品“线上净网线下清源”风险排查处置工作，主动承诺自觉抵制利用网络生产销售违法化妆品行为，促进化妆品网络销售市场持续健康发展。 （四）宣传教育公众树立安全用妆意识。 结合“化妆品安全科普宣传周”活动，推动主要化妆品电子商务平台经营者于2019年5月同步上线化妆品消费提示语“国家药监局提示您：请正确认识化妆品功效，化妆品不能替代药品，不能治疗皮肤病等疾病”，提醒广大消费者防范化妆品消费风险。以协调主流媒体宣传报道等多种形式，宣传安全用妆、理性用妆知识。畅通投诉举报渠道，提高化妆品安全投诉举报处理效率。 五，工作要求 各省（区、市）药品监管部门要高度重视化妆品“线上净网线下清源”风险排查处置工作，明确专人负责，加强对风险排查处置工作进展情况的监督检查，有针对性地开展化妆品网络抽检，发现违法行为，依法予以查处。对未按照要求开展风险排查处置工作的化妆品网络销售者和化妆品电子商务平台经营者将作为重点监管对象，加大监督检查和抽检力度，必要时约谈其法定代表人或者主要负责人，对发现的违法行为，依法从严查处。 各省（区、市）药品监管部门要对风险排查处置工作进展情况进行总结和分析，梳理存在的问题并提出工作建议，填写风险排查处置工作表（见附件），并于2019年8月31日前将风险排查处置工作总结报国家药监局化妆品监管司。工作中如有重大事项，应当及时报告。 国家药监局综合司2019年4月29日
